Child Trends and the National Research Center on Hispanic Children & Families responded to a request for public comment on new rules proposed by the U.S. Department of Homeland Security. Our joint comment reflects our shared commitment to inform policies that improve the lives of Hispanic children and their families. We recommend that the agency withdraw its proposal to define who is considered a “public charge”—the statutory term used for a person who is dependent on the government for subsistence—through regulation. A person designated a “public charge” can be denied admission to the United States or denied a change in their legal status. We believe the proposed rule will cause undue harm to children and would disproportionately affect Hispanic families and children.
